The New York indictment did not include eight weapon-possession counts. It listed seven weapon-possession counts, and one of those was later dismissed in June 2026.

In the official New York court opinion reviewing the indictment, the court lists the state counts as:
- two counts of criminal possession of a weapon in the second degree,
- three counts of criminal possession of a weapon in the third degree? No—the opinion actually breaks third-degree possession into four total counts (one under §265.02[7], two under §265.02[8], and one under §265.02[2]), and
- one count of criminal possession of a weapon in the fourth degree.
That adds up to 7 weapon-possession counts total, not 8.
Separately, AP reported on June 17, 2026 that Judge Gregory Carro dismissed an additional state charge related to a gun magazine, meaning the current number of surviving state weapon counts is lower still. So whether you look at the original indictment or the case as it stands now, "8 counts" is incorrect.
