Government guidance says the offence covers "penetrative sexual activity between people who a reasonable person would think are related, or pretending to be related, in a certain way."

The statutory text is more specific still. Section 67E applies only where the image is pornographic and "portrays, in an explicit and realistic way" a person sexually penetrating another person, and a reasonable person would think the participants are related (or pretending to be related) in listed relationships.

So the law does not ban "anything regarding family/incest"; it targets a defined subset of explicit pornographic depictions of penetrative sex between specified relatives or role-played relatives.

The post compresses the rule into "anyone appearing to be under 16," but that is not what the law says.

According to the Ministry of Justice guidance, the offence covers "sexual activity between at least 2 people where a reasonable person would think at least one person is, or is pretending to be, under 16."

Section 107 is equally specific: the image must be pornographic, and a reasonable person must think it "portrays, in an explicit and realistic way, a person (A) engaged in sexual activity with another person (B)" and that "at least one of A or B is, or is pretending to be, under 16." The Act also says this offence does not capture cartoon images, though it can capture realistic AI-generated images.

So the law is about a defined category of explicit pornographic sexual activity involving someone who is or appears to be under 16—not just "anyone appearing to be under 16" in general.
